Terms of Service

These Terms of Service (“Terms”) govern your use of the Pine Valley Estates website, registration forms, and online booking platform (the “Service”), operated by HomeLife Regional Realty Inc. (“we,” “us,” “our”). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under Ontario law to use the Service.

2. The Service

The Service lets you express interest in our new-construction communities, book a site visit or phone consultation, and receive follow-up communications from our sales agents. The Service is provided free of charge.

3. Accuracy of information

We make reasonable efforts to keep community details, model availability, pricing, lot maps, and visit times accurate and up to date. However:

  • Home prices, floor plans, elevations, lot availability, and incentives are subject to change without notice. Listings on the website are for illustration only and do not constitute a binding offer.
  • A booked site visit or phone consultation is a meeting commitment, not a reservation of any specific home or lot.
  • Any binding agreement to purchase a home will be made only through a formal Agreement of Purchase and Sale executed by you and the authorized representative of the builder/seller.

4. Bookings and cancellations

When you book a site visit or phone consultation through the Service, you receive a confirmation email with the agent’s name and a calendar invitation. If you need to cancel or reschedule, please reply directly to that email, or contact us at info@send.pinevalleyestatesltd.com with as much notice as possible.

We may cancel or reschedule a booking if circumstances make the original time unworkable (e.g., agent illness, weather, site closure). We will make reasonable efforts to notify you in advance.

5. Acceptable use

You agree not to:

  • Submit false or misleading information.
  • Use automated tools (scrapers, bots, headless browsers) to interact with the Service, except for legitimate search-engine indexing.
  • Attempt to gain unauthorized access to the Service, the CRM, or any accounts that are not your own.
  • Reverse engineer, decompile, or extract the source code of the Service.
  • Use the Service to send spam, harass our staff, or transmit malicious content.
  • Use the Service to compete with us, scrape our community/pricing information, or republish it without written permission.

We may suspend or terminate access for users who violate these rules.

6. Intellectual property

All content on the Service — including text, images, floor plans, lot maps, logos, and the Pine Valley Estates name — is owned by us or our licensors and is protected by Canadian and international copyright and trademark law. You may view and share content for personal, non-commercial purposes only.

7. Third-party integrations

The Service relies on third-party providers (Vercel, Supabase, Resend, Anthropic, Google Calendar, OpenStreetMap). See our Privacy Policy for details. We are not responsible for outages, errors, or data practices of these third parties. Their use is governed by their own terms.

8. Disclaimer of warranties

The Service is provided “as is” and “as available.” We make no warranty that the Service will be uninterrupted, error-free, secure, or fit for any particular purpose. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by Ontario law, our total liability arising from your use of the Service is limited to fifty Canadian dollars (CAD $50). We are not liable for indirect, incidental, consequential, or punitive damages — including lost opportunity, lost data, or lost profits — even if we have been advised of the possibility.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for fraud or gross negligence).

10. Indemnity

You agree to indemnify and hold harmless Pine Valley Estates, HomeLife Regional Realty Inc., and their officers, employees, and agents from any claim arising out of your breach of these Terms or your misuse of the Service.

11. Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be brought exclusively in the courts of Ontario, and you consent to their jurisdiction.

12. Changes to these Terms

We may revise these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after a change constitutes acceptance of the revised Terms.
